MIAMI (AP) ? When Gregg Popovich gives his best players a night off to rest, it's not uncommon for the San Antonio Spurs coach to get letters from upset fans.
This time, he's going to hear from an upset commissioner ? even after Popovich's short-handed team nearly knocked off the Miami Heat.
Ray Allen's 3-pointer with 22.6 seconds left gave Miami the lead, LeBron James finished with 23 points and the Heat rallied to beat the Spurs 105-100 on Thursday night ? digging deep despite San Antonio's decision to have four top players resting at home in a move that bothered NBA Commissioner David Stern.
The Spurs played without Tim Duncan, Tony Parker, Manu Ginobili and Danny Green, all sent back to San Antonio by Popovich, who said the move was in his team's best interest.
"I don't think Pop was in the wrong," James said.
Stern disagreed, calling the decision "unacceptable," apologizing to fans and saying that sanctions against the Spurs will be forthcoming.
"Oh, it would have been great if we won," Spurs forward Matt Bonner said after hearing about Stern's statement. "It goes back to what I was saying, I'm sure everybody else was saying before the game. We have faith in everybody on our roster. We think we have one of the deepest teams in the league."
The Heat weren't disagreeing afterward.
"We survived," Chris Bosh said. "And we won. They have a bunch of talented guys over there. I know that nobody's going to really give them credit, but they are a tough bunch."
How tough? Try this ? the Spurs led by seven with 4:48 left, and the margin was 98-93 when Gary Neal made a 3-pointer with 2:14 remaining.
From there, Miami closed on a 12-2 run.
But all anyone will likely remember from this one is Popovich's decision ? and whatever Stern does as a result.
"I apologize to all NBA fans," Stern said. "This was an unacceptable decision by the San Antonio Spurs and substantial sanctions will be forthcoming."
Allen scored 20 points, Dwyane Wade added 19 and Chris Bosh finished with 18 points and 12 rebounds for Miami, now 7-0 at home.
Neal had 20 points for the Spurs. Tiago Splitter scored 18 points, Nando De Colo added 15, Boris Diaw scored 12 and Bonner had 10 for San Antonio, which finished a six-games-in-nine-nights road trip with a 5-1 record. Bonner also had 10 rebounds, one more than he had grabbed all season entering the game.
"Pop is the coach of the San Antonio Spurs," Neal said. "He did what's best for us."
The Spurs' five starters Thursday night came into the game averaging a combined 23.6 points, or 1.6 points less than James averaged entering the game.
And when the Heat ran out to a 16-6 lead, it seemed a blowout was in the offing. After all, even the oddsmakers in Las Vegas expected it to be that way ? the Heat were favored by six points in most sports books before the news broke that the Spurs' regulars were resting, after which the line swelled to 13.
Apparently, no one told the Spurs that the second-string was supposed to play second-fiddle.
San Antonio closed the first quarter on a 21-6 run, taking a 27-22 lead after the period, and simply did not go away. The Spurs led by as many as seven at one point, and after James Anderson made a pair of free throws with 0.6 seconds left in the third, San Antonio held a 76-73 lead heading into the final 12 minutes.
But once again, James-to-Allen proved magical for Miami.
With the Heat down by one, James nearly lost the ball in the lane, collected himself and kicked it out to Allen, who connected from the left wing to put Miami ahead to stay. James also set up Allen for a final-moment four-point play to lift Miami over Denver earlier this season, along with another late 3-pointer that helped the Heat edge Cleveland last weekend.
"Every time a guy turns his head I have to find the open spot so LeBron can see me," Allen said. "Anything can happen out there. We put ourselves in such a tough situation, but we kept plugging away."
Thing is, no one ever thought it would come down to that.
Before the game, Popovich said he decided to sit his core when he saw how challenging this particular part of the schedule was for his team.
"Everybody has to make decisions about their schedule, about players playing and back-to-backs and trips and that sort of thing," Popovich said before the game. "In our case, this month we've had 11 away games, after tonight. We've had an eight-day trip and a 10-day trip, and we're ending it with four (games) in five nights here. I think it'd be unwise to be playing our guys in that kind of a situation, given their history."
It's not unlike other moves Popovich has made before; in fact, not only did he give Duncan, Parker and Ginobili time off together toward the end of last season, which was condensed by a lockout, he actually flew home to San Antonio with them and took a two-game, pre-playoff sabbatical.
This decision, Popovich said, was more about a home matchup with surging Memphis on Saturday.
"Perhaps it'll give us an opportunity to stay on the court with Memphis on Saturday night," Popovich said. "Historically, when you're on a long road trip, that first game when you come home is really tough. And Memphis is one of the best teams in the league. They're of much more concern to us than playing four games in five nights. It's pretty logical."
Given Stern's statement, it's also logical to think that the Spurs could know their penalty by Saturday as well.
NOTES: Miami last played on Saturday, at home; San Antonio had played on Sunday, Monday and Wednesday, all on the road. ... A moment of silence was held before the game for Sasha McHale, the daughter of Houston coach Kevin McHale. Sasha McHale died Saturday at age 23. ... It was the third straight home game in which Miami trailed in the fourth quarter.

When the Space Shuttle Atlantis made its final landing at the Kennedy Space Center in July 2011, NASA's future plans to launch astronauts were left up in the air.? This, even as other countries, notably China, said they had concrete exploration plans and committed budgets.
In the original space race of the 1950s and 1960s, the Soviet Union launched the first human being, Yuri Gagarin, into orbit in 1961.? The United States gradually caught up; Neil Armstrong was first to walk on the moon in 1969.
In the decades that followed, Russia concentrated on space stations while the U.S. tried to turn its space shuttle into an affordable way to launch astronauts and satellites.? But after the loss of the shuttle Columbia in 2003, the U.S. decided to wind the program down.? ?It is now trying to outsource some launches to private companies such as SpaceX, while NASA, working with a limited budget, develops plans for deep space exploration.
Meanwhile, the Chinese space program moves slowly along.? In June it launched its first female "taikonaut" -- as Chinese astronauts are known -- and performed a docking with an orbiting laboratory.? It talks of establishing its own space station by 2020 and later sending explorers to the moon.
The member states of the European Space Agency have committed more than 10 billion Euro to upgrade their own rockets.? The Europeans will provide the propulsion unit for NASA's newest spaceship, Orion, which has a scheduled test launch in September of next year. But with no mandate from the Obama Administration or Congress, plans to send astronauts back to the moon or on to Mars are, for now, going nowhere.

NEW YORK (AP) ? Attorneys for Dominique Strauss-Kahn on Friday denied that the former International Monetary Fund chief has reached a settlement with a New York City hotel maid who accused him of trying to rape her.
William Taylor III and Amit Mehta said in a statement issued Friday that the parties have merely "discussed a resolution."
A person familiar with the case told The Associated Press on Thursday that a settlement had been reached. The person spoke to the AP on condition of anonymity to discuss the private negotiation.
"Media reports that Dominique Strauss-Kahn has agreed to pay $6 million to settle the civil case are flatly false," the attorneys said. "The parties have discussed a resolution but there has been no settlement. Mr. Strauss-Kahn will continue to defend the charges if no resolution can be reached."
French newspaper Le Monde, citing people close to Strauss-Kahn, reported the $6 million figure.
Strauss-Kahn's Paris lawyers, Frederique Baulieu, Richard Malka and Henri Leclerc, said they "vigorously deny the fantasist and erroneous information" published by Le Monde.
Lawyers for the maid didn't return a message Thursday.
The New York Times first reported the agreement had been reached.
A settlement would bring an end to a saga that has tarnished Strauss-Kahn's reputation, ended his hopes for the French presidency and renewed a debate about the credibility of sexual assault accusers.
But it might not mean the end of his legal troubles. He is awaiting a ruling on whether he is linked to "pimping" in connection with a French prostitution ring.
The person familiar with the New York case told the AP on Thursday that lawyers for Strauss-Kahn and the housekeeper, Nafissatou Diallo, made the as-yet-unsigned agreement within recent days, with Bronx Supreme Court Justice Douglas McKeon facilitating that and a separate agreement to end another lawsuit Diallo filed against the New York Post. They are slated to meet next week to formally sign the agreement, the person said.
Prosecutors dropped related criminal charges last year.
If any deal were veiled by a confidentiality agreement, Strauss-Kahn and Diallo might not speak publicly about a May 2011 encounter that she called a brutally sudden attack and he termed a consensual "moral failing."
Diallo, 33, and Strauss-Kahn, 63, crossed paths when she arrived to clean his luxury Manhattan hotel suite. She told police he chased her down, tried to yank down her pantyhose and forced her to perform oral sex.
The allegation seemed to let loose a spiral of accusations about the sexual conduct of Strauss-Kahn, a married diplomat and economist who had long been dubbed the "great seducer."
With DNA evidence showing a sexual encounter and Diallo providing a gripping description of an attack, the Manhattan district attorney's office initially said it had a strong and compelling case. But within six weeks, prosecutors' confidence began to ebb as they said Diallo had lied about her past ? including a false account of a previous rape ? and her actions after leaving Strauss-Kahn's room.
Diallo, who's from Guinea, said she told the truth about their encounter. But the district attorney's office dropped the charges in August 2011, saying prosecutors could no longer ask a jury to believe her.
Diallo had sued Strauss-Kahn in the meantime, with her lawyers saying she would get her day in a different court. Strauss-Kahn called the lawsuit defamatory and countersued for $1 million.
The Associated Press does not name people who report being sexually assaulted unless they come forward publicly, as Diallo has done.

Since there?s a good chance that you?re wondering the same thing, I thought I?d share my recommendations for five books, that in my opinion, do an excellent job of explaining, in a thorough and unbiased way, the many medical and emotional issues that occur during the menopause years.
Do what I do and check these books out of your local library to first see which one you like the best, then purchase it for your own personal library. That way, you?ll always have good, reliable information at your fingertips for years to come.
The first?Our Bodies, Ourselves?was?written for us in the early 70s. It was a landmark book that helped fuel the women?s liberation movement with its frank discussion of a woman?s body. The publishers, the?Boston Women?s Health Book Collective, caught up to us again six years ago with this edition on Menopause, which I find equally progressive. They cover the basics of Menopause (?What?s Happening in Our Bodies?), which I think women just entering the perimenopausal phase will find particularly helpful.
What makes this book stand out??I like the way the authors have included a discussion of non-medical, emotional issues that have to do with our ?changing selves,? in chapters on body image, sexuality, and family life and the workplace.

The Smart Woman?s Guide to Midlife and Beyond: The No-nonsense Approach to Staying Healthy After 50,? is authored by Drs. Janet Horn, a gynecologist and Robin Miller, an internist who specializes in integrative medicine.? They?re both in their 50s and have been friends since their med school days, so their close rapport is reflected in the way they provide information and advice. They talk about their own experiences, share patient stories and conclude each chapter with a ?chat? that makes you feel that you?re among friends who are dealing with the same mid-life changes as you.

I?d bet that whatever question you have about the changes you?re experiencing will be answered in these pages.
What makes this book stand out?? I applaud the author for bringing up the need to find a doctor whose qualifications match your?new?needs.? This one thing can make a big difference in how well you navigate the menopause years. In her chapter titled, ?A Partner on the Path ? Choosing a Health Care Provider,? Ms. Kalb encourages readers to explore your options early in the menopausal process and then, once you?ve found the right practitioner, take charge.
Since it?s publication date two years ago, I?ve been recommending Ellen Dolgen?s book,?Shmirshky: the pursuit of hormone happiness?to my younger friends in the sputtering stage of menopause (aka perimenopause), who don?t have a clue about what?s happening to their bodies or what to expect in the years ahead. The author covers a lot of ground ? from HRT and hot flashes to memory lapses and vaginal dryness ? in an intimate, girlfriend-to-girlfriend voice that makes this book instructive and engaging.
What makes this book stand out? ?Like Kate Bracy Kalb in her book (above), Ellen Dolgen writes about the need to find a great gynecologist who specializes in women?s midlife health, who can be your partner in this decade-long journey. She offers suggestions for how to research and then interview prospective candidates for this important job. (She also offers a directory on her website.)
Finally, I highly recommend Dr. Susan Love?s Menopause and Hormone Book.?It?s an important book that, besides the basics, covers weighty issues such as the medicalization of menopause, understanding research when it comes to prevention and risk of disease and women?s cancers.
What makes this book stand out??Dr. Love is one of the most respected women?s health specialists in this country. ?With this book, she can be a trusted resource for evidenced-based, unbiased information.

On every corner there is a sandwich shop, restaurant or bar to fill your fix of all tradition and non-traditional dishes. But, what makes Italy so different from any other place? The Italian food culture is completely different in every aspect to the United States; some examples are those of; times of eating, service, types of meals and the billing procedure.
In comparisons to the American culture, Italians eat their dinner quite late. The earliest dinnertime is around 7:00 in the evening.? Most restaurants don?t even open their doors until this time.? There is also a ?deal? that some restaurants put together called ?aperitivo?. Compared to the American culture, this would be ?Happy Hour?. In the Italian culture, they add a buffet of finger foods for you when you purchase a drink, for about seven euro a person. I recommend experiencing this evening event. In the Italian culture, it is a fun way to eat a lot, enjoy Italian company, and kick back and relax. ?Some hot spots in the city are Kitsch, Moyo, Zoe, and Rex Caf?.
If you are looking for a more traditional style of meal, going to a restaurant and ordering off the menu is always an option. When ordering beverages getting a soda isn?t as common as it would be in the United States. Wine or water is the normal table drink. Not all wines are a-custom to the dinner table however. The house red or house white is always a delicious taste with your dinner. Don?t order sweet wines such as moscato, save those for dessert! In Italy, the meals are separated into different courses.? When ordering, you asked for all your courses at once. So start with the appetizer and order through your second course at once. Starting off you dinner with first the appetizer, known as antipasti. These dishes are normally light such as caprese, bruschetta, or prosciutto e melone. The primo (first course) is anything that doesn?t have meat.? The pasta dishes or soups are always a good choice. Your secondi (second course) are your meat dishes. This would include the famous Florentine steak, seafood, chicken and so on.? See the difference between Italian and American ordering styles? Everything is ordered and priced separately.
Along with this, it is also eaten separately.? The dishes come out as they are prepared to eat and in order of sequence of the course you order. ?I?ve learned by meeting Italian friends and going out to dinner with them that it is customary and polite to wait for your entire table to receive their dishes before beginning to eat.
Another difference that you may want to take note of is the payment process. In the Italian culture when out in large groups, make sure you have money to collect as a table. The restaurant will ring your bill up on one tab. Before you worry about getting the bill paid for, remember to flag down your waiter or waitress to tell them you are ready for your check.
Lastly before you leave from your meal, Americans always seem to ask amongst them-selves, ?Do I tip?? They answer to that is ?as you wish?. For most restaurants there is what is called a ?service charge?. This is normally about the price you would tip your waiters at home so no, it is not. However, if you believe your service was wonderful you are always more than welcome and the servers are more than happy for you to recognize them by leaving a little extra.
Cuisine is an interesting way to learn the culture and try something new. Don?t be afraid to point to something on the menu and have that for dinner. Be courageous with your taste buds. Chances are likely that whatever you order will be delicious!

The Golden State Warriors are currently ranked somewhere in the middle of the NBA power rankings. The Sacramento Kings are far less fortunate.
The NBA power rankings are out! How do the Bay Area teams fare?
The 8-6 Golden State Warriors are doing quite well. Marc Stein has them at 14th, rising them up five spots and noting Golden State's tough road stretch. John Hollinger has them even higher at 12th, a spot where they've stayed for much of the year.
The Warriors also jump up from 20th to 13th in Seth Rosenthal's rankings from SB Nation. They make a huge leap from 16th to 10th in the latest power rankings from CBS Sports after picking up win after win. Then Kurt Helin of NBC Sports put the Warriors up to 17th from 18th, still expressing skepticism how long the Dubs could survive without Andrew Bogut.
The 4-9 Sacramento Kings aren't in as great shape. Stein puts them in 24th, moving them up from 28th thanks to wins over the Jazz and Lakers. Hollinger has them lower, placing them right at 26th. Rosenthal moves them up from 29th to 25th, pointing out the improved rebounding by each team. The Kings made the move from 28th to 26th in CBS's rankings, and leapt from 29th to 25th in NBC's rankings thanks to their lineup change.

Dr. Joseph E. Murray, who opened a new era of medicine with the first successful human organ transplant, died on Monday in Boston. He was 93.
He died at Brigham and Women?s Hospital, where he performed his first transplant, said Tom Langford, a hospital spokesman. The cause was complications of a stroke he suffered on Thursday, Mr. Langford said.
Dr. Murray?s groundbreaking surgical feat came in 1954, when he removed a healthy kidney from a 23-year-old man and implanted it in the man?s ailing identical twin. Dr. Murray went on to pioneer techniques that over the years changed the lives of tens of thousands of patients who received new kidneys, hearts, lungs, livers or other organs after their own had failed.
In 1990, he was awarded the Nobel Prize in Physiology or Medicine.
As director of the Surgical Research Laboratory at Harvard Medical School and at Peter Bent Brigham Hospital in Boston, which became Brigham and Women?s, Dr. Murray was a leader in the study of transplant techniques, the mechanisms of organ rejection and the use of drugs to thwart it.
Among other procedures, he performed kidney transplants involving more than two dozen pairs of identical twins. He performed the first successful transplant to a nonidentical recipient, in 1959, and the first using a cadaver kidney, in 1962. And he trained doctors who became leaders in transplantation around the world.
Though Dr. Murray devoted most of his career to reconstructive plastic surgery, he was most famous as a transplant surgeon, especially after receiving the Nobel. He shared the $703,000 prize with Dr. E. Donnall Thomas, a pioneer in bone marrow transplantation, who died in October.
Joseph Edward Murray was born on April 1, 1919, in Milford, Mass., the son of William Murray, a judge, and Mary DePasquale Murray, a schoolteacher. He attended the College of the Holy Cross and Harvard Medical School, from which he graduated in 1943. After an abbreviated internship at Brigham, he entered the Army Medical Corps in 1944.
It was his experience as an Army doctor, especially using cadaver skin to treat burned soldiers, that led him to both transplantation and facial reconstruction, Dr. Murray said in an interview in 2001. Though the transplanted skin would survive for only 8 or 10 days before it would ?begin to melt around the edges,? he recalled, the experience taught him that tissue from one person might survive for a time in another and that it might be possible to use ?tissue from a dead person to save a human life.?
So when he returned to civilian life and began practicing as a plastic and general surgeon at Brigham, he joined colleagues in investigating the possibilities of organ transplants. At the time, he recalled, organ transplantation was considered such a wild dream that a medical school mentor advised him to abandon the idea as a clinical dead end.
At Brigham, the work ?was considered a fringe project,? he wrote in his autobiography, ?Surgery of the Soul,? published in 2001 by Science History Publications/USA.
But he and his colleagues began testing surgical techniques with dogs, removing and reimplanting kidneys. Then, in October 1954, Richard Herrick, a Massachusetts man dying of chronic nephritis, a kidney disease, was admitted to the hospital, and his doctors referred him to Dr. Murray as a possible transplant recipient. The man?s identical twin, Ronald, was willing to give him a kidney. Would Dr. Murray perform the surgery?
It was a daunting prospect. Dr. Murray worried about ?taking a normal person and doing a major operation not for his benefit but for another person?s,? he said in the 2001 interview.
?We were criticized for playing God,? he said.
After consulting with clergy members from a range of denominations, and comparing the Herricks? fingerprints to be sure they were identical and not merely fraternal twins, Dr. Murray and his colleagues decided to go ahead. They first practiced their surgical techniques on a cadaver. The donor kidney ?was the only kidney in the universe that was compatible,? Dr. Murray said, ?and I did not want to goof it up for technical reasons.?
The surgery took place on Dec. 23, 1954. As Dr. Murray wrote later, ?There was a collective hush in the operating room? as blood began to flow into the implanted kidney and urine began to flow out of it.
Richard Herrick, who later married one of his nurses, survived until 1962, when he died of a recurrence of his original disease. Ronald Herrick died in 2010 at 79.
Two other patients were important to Dr. Murray?s medical career, both professionally and personally.
The first was Charles Woods, a 22-year-old Army flier who had been badly burned in December 1944 when his plane crashed in Burma (now Myanmar). He was flown to Valley Forge General Hospital in Pennsylvania, where Dr. Murray was a junior member of the medical team that treated Mr. Woods with scores of skin grafts and operations to reconstruct his destroyed face and hands.

CHICAGO (AP) ? The numbers have been drawn for the record Powerball jackpot and the wait for winners ? if any ? has begun.
The numbers drawn Wednesday night are: 5, 16, 22, 23, 29 and Powerball of 6.
A lottery official said late Wednesday that the jackpot increased to $579.9 million by the time of the drawing, making the cash option $379.8 million.
Americans went on a ticket-buying spree in recent days, the big money enticing many people who rarely, if ever, play the lottery to purchase a shot at the second-largest payout in U.S. history.
Among them was Lamar Fallie, a jobless Chicago man who said his six tickets conjured a pleasant daydream: If he wins, he plans to take care of his church, make big donations to schools and then "retire from being unemployed."
Tickets were selling at a rate of 130,000 a minute nationwide ? about six times the volume from a week ago. That meant the jackpot could climb even higher before the Wednesday night drawing, said Chuck Strutt, executive director of the Multi-State Lottery Association.
The jackpot had already rolled over 16 consecutive times without a winner, but Powerball officials said earlier Wednesday they believed there was a 75 percent chance the winning combination will be drawn this time.
If one ticket hits the right numbers, chances are good that multiple ones will, according to some experts. That happened in the Mega Millions drawing in March, when three ticket buyers shared a $656 million jackpot, which remains the largest lottery payout of all time.
Yvette Gavin, who sold the tickets to Fallie, is only an occasional lottery player herself, but the huge jackpot means she'll definitely play this time. As for the promises she often gets from ticket purchasers, Gavin isn't holding her breath.
"A lot of customers say if they win they will take care of me, but I will have to wait and see," she said.
In the hours before Wednesday's drawing, Associated Press photographers across the nation sought out ticket buyers and asked about their lottery fantasies. Here's a look at what they found:

When Atlanta barber Andre Williams buys scratch-off tickets, he typically does a dance in his shop for good luck. As a first-time Powerball player, he plans to reprise the dance ? and buy a few extra tickets to enhance his chances.
I don't even know if I'll look at it," said Williams, who bought his ticket at a newsstand. "If I win, I might pass out."
Paralegal Pat Powell was buying her first Powerball ticket at another store in Atlanta, even though she acknowledged her odds were probably "zero to zero."
Still, Powell has specific plans should she win: start an Internet cafe in the West Indies and a learning center in Georgia.
"I've been thinking about winning this money and what I'd do with it," Powell said. "There's no ritual, but it's just been on my mind. So it's like, let me just join the hype and just do it."
Atlanta accountant Benita Lewis, who had never played the lottery before, didn't want to be the only one left in her office without a ticket.
"I did feel nervous buying it like I could be the one," she said. "I'm going to retire and pay off all my family's debt."

In Philadelphia, seafood salesman Billy Fulginiti bought 50 Powerball tickets with co-workers and a few more with a small group. He said he only plays when the jackpot is especially large.
"You go to bed at night wishing you wake up a millionaire," Fulginiti said. He planned to take a long vacation and "help a lot of people, a lot of charities," if any of his tickets turn out to be winners.

Powerball purchases at the Canterbury Country Store in Canterbury, N.H., have been so steady that the manager has been working extra evening hours to keep up.
Horticulturist Kevin Brags buys tickets at the store two to three times a month. He says he usually picks numbers higher than 32 because so many people use numbers 31 and lower, largely because of birthdays.
The birthday theory didn't scare off Paul Kruzel, a retired doctor who chooses the days his children were born.
Both, however, have the same plans for winning: "make a lot of people happy."
John Olson has a more elaborate idea: He'd like to buy an island.

At a downtown Detroit convenience store, Ceejay Johnson purchased five Powerball tickets. If she strikes it rich, the analyst from Southfield, Mich., said she would buy a home for her sister in Florida. Then she would "go into hiding" and take care of her family.
"And the IRS," she added.

BP agreed to pay the largest criminal fine ever brought against a single corporation; the U.S. government in turn agrees not to press more charges against the oil company responsible for the 2006 oil spill. NBC's Pete Williams reports.

Two former BP employees were charged Wednesday with manslaughter in the 2010 Gulf spill disaster, while BP itself was blocked from bidding for U.S. government contracts until it shows it no longer lacks "business integrity". BP responded by saying it was working with the Obama administration to do just that.?

In New Orleans, a BP rig supervisor said he is innocent of manslaughter in the deaths of 11 workers in the 2010 explosion on the Deepwater Horizon offshore drilling rig that started the spill disaster.
"I think about the tragedy of the Deepwater Horizon every day," Robert Kaluza told reporters just before his arraignment. "But I did not cause this tragedy. I am innocent and I put my trust, reputation and future in the hands of the judge and the jury."
Kaluza and Donald Vidrine, both BP well site leaders, were indicted earlier this month on manslaughter charges. The federal indictment accuses them of disregarding abnormal high-pressure readings that should have been clear indications of trouble just before the explosion.
Kaluza's attorney, Shaun Clarke, said the men are scapegoats.
"Bob and Don did their jobs," Clarke said. "They did them correctly and they did them in accordance with their training."
BP announced earlier this month that it will plead guilty to manslaughter, obstruction of Congress and other charges and pay a record $4.5 billion in penalties to resolve a Justice Department criminal probe.
Attorneys for BP and the Justice Department are scheduled to meet Dec. 11 with a federal judge to discuss a date for BP pleading guilty.

The Deepwater Horizon oil rig, owned by Transocean Ltd. but operated on behalf of BP, was drilling in the Gulf of Mexico off the Louisiana coast on April 20, 2010, when it was rocked by an explosion.
The bodies of 11 workers were never recovered.
Former BP executive David Rainey was charged separately Wednesday with concealing information from Congress about the amount of oil that was leaking from the well. Millions of gallons of crude oil spewed from BP's well for months.
Also Wednesday, the Environmental Protection Agency?banned BP from new federal contracts over its "lack of business integrity".
BP and its affiliates must demonstrate they can meet federal business standards, the EPA said. The suspension is "standard practice" and BP's existing U.S. government contracts are not affected, it said.?
On the docks in Louisiana, fishermen and oystermen say the effects of the BP oil spill remain today. NBC's Anne Thompson has more.
In a statement, BP said it has been in "regular dialogue" with the EPA, and that the agency has informed BP that it is preparing an agreement that "would effectively resolve and lift this temporary suspension." The EPA has notified BP that the draft agreement will be available soon, BP said.
The U.S. government could use the suspension as leverage to pressure BP to settle civil charges, which could top $20 billion if BP is found to be grossly negligent for the spill under the U.S. Clean Water Act.?
The Justice Department says it intends to prove in a court case set to get underway in February that BP was grossly negligent, a claim the company has adamantly refuted.
BP and the U.S. government likely worked out a deal on the timing of the suspension before BP agreed to sign off on the Nov. 15 criminal plea deal, said Samuel Buell, a Duke University Law School professor and former federal prosecutor.?
"It's just inconceivable to me that BP's lawyers, that their board of directors would have entered into that agreement last week without the issue of a suspension or debarment having been addressed," Buell said.
One long-time critic of BP applauded the decision.?
"After pleading guilty to such reckless behavior that killed men and constituted a crime against the environment, suspending BP's access to contracts with our government is the right thing to do," U.S. Rep. Edward Markey, a Democrat from Massachusetts, said in a statement.

LONDON (AP) -Lionel Messi moved back to the top of the AP Global Football rankings, and Barcelona stayed No. 1 in the team poll after a 4-0 win over Levante in the Spanish league.
Messi earned 183 out of a possible 200 points from The Associated Press' panel of 20 global football journalists. Last week's winner, Paris Saint-Germain striker Zlatan Ibrahimovic, was second. Ibrahimovic topped the previous poll mainly for his four goals for Sweden against England.
Barcelona was voted the top club of the week after stretching its lead to three points over Atletico Madrid and 11 points over third-place Real Madrid.
Ibrahimovic garnered 124 points, while another Barcelona player, Andres Iniesta, leapt into third place with 119.
"Two clinical finishes from Messi got Barca rolling towards a 4-0 win against Levante and followed his Champions League double against Spartak," panelist Will Tidey of the San Francisco-based Bleacher report said. "Gerd Mueller's record is just three goals away."
Mueller, a former Germany and Bayern Munich great, holds the record for most goals scored in a calendar year with 85.
The panel's two Italian voters, Paulo Condi of La Gazzetta Dello Sport and Aurelio Capaldi of Rai Sport, paid tribute to Iniesta.
"He made things easy for Barca as he twice set up Messi, scored a goal and allowed Cesc Fabregas to kill the game," Capaldi said.
Borussia Dortmund, which is giving Bayern Munich a fight in the Bundesliga, had two players in the top five. Striker Robert Lewandowski was fourth with 83 points and midfielder Mario Goetze, who played a key role in Lewandowski's two goals in Saturday's 2-1 victory over Mainz, was fifth with 63.
"Mario Goetze is currently in superb form," Christian Schaetzle of website derfussballblogger.de said. "He was the outstanding player in both Dortmund's Champions League win in Amsterdam and in his side's important away win at Mainz in the Bundesliga, involved in nearly all the goals."
Several panelists thought Philippe Mexes' overhead kick in AC Milan's 3-1 Champions League victory at Anderlecht was even better than Ibrahimovic's dramatic goal against England a week earlier.
"His goal was more beautiful than that of Ibrahimovic, because he controlled the ball first with the chest and there was a goalkeeper between the posts," Francois Colin of Belgium's De Standaard said. "Most of all this was a game that mattered."
For Filip Bondy of the New York Daily News, it was a "prettier goal in many ways than the bicycle kick from Ibrahimovic."
Mexes' efforts brought him into sixth place.
With Barcelona seemingly glued into the top team position, Bayern and Dortmund were second and third in the AP poll, with no English team in the top five for the first time since the survey began.
Barcelona had 176 points, well ahead of Bayern with 129 and Dortmund with 105. Real Madrid, which lost to Real Betis on Sunday, plunged to 24th.
